Constitution expert Subhash Kashyap has said that proposals of the Union government to scrap Article 370 and divide Jammu and Kashmir into two union territories are constitutionally sound. Kashyap told news agency ANI, "I can only say, constitutionally it is sound, no legal & constitutional fault can be found in it. Govt has carefully studied the matter." Kashyap didn't say anything on the question of whether Modi government's Kashmir decision is a political decision or not.
Strong reactions have come both in support and against the government's proposals. Punjab Chief Minister Amarinder Singh said, "Constitution of India had been rewritten without following any legal provisions. Such a historic decision should not have been taken and pushed through in this arbitrary manner."
Union Home Minister Amit Shah On Monday proposed to scrap Article 370 of the Constitution which gives special status to Jammu and Kashmir and said the state will be split into two Union Territories: Jammu and Kashmir with an Assembly and Ladakh without one. Shah said: "I am presenting the resolution to revoke Article 370 in Jammu and Kashmir except the first clause 370 (1)." In a separate statement, the Home Minister said that the government had proposed to reorganize Jammu and Kashmir carving out two separate Union Territories of Ladakh and Jammu and Kashmir.
