A man who can afford to maintain a car in an expensive city like Mumbai, cannot ignore giving maintenance to estranged wife, a Mumbai sessions court has ruled. DNA reported today that the court's observation came in a case filed by a woman against her husband.

The woman had got married to the man in 2015. As per the report, she said the marriage remained smooth for the first few days but soon her husband's family started assaulting her for dowry. The woman has been living with her parents after separating from the man. She approached the court to appeal against the order of a Magistrate's court that had asked the man to pay just Rs 2000 towards her monthly maintenance. 

The session court has now asked the man to pay a monthly maintenance of Rs 5000 to the estranged wife. While hearing the appeal filed by the woman, the court said that the man can definitely afford to maintain his estranged wife because of the very fact that he can afford to have a car in a place like Mumbai. 

“The man has a monthly income above Rs one lakh. He also owns an Alto car. In Mumbai, if a man can maintain a car, it means that his financial position is sound. Thus, it is essential for him to pay a maintenance of Rs 5,000 towards his estranged wife,” read the court order, according to DNA. 

The report further said that a family court had ordered the man to pay Rs 8000 as maintenance to the estranged wife but he failed to do so and an outstanding amount of Rs 6,33,000 is already pending against him.
