According to a PTI report, the Maharashtra State Board of Secondary and Higher Secondary Education on Monday told the Bombay High Court it had not devised a formula as yet on how to evaluate and mark Maharashtra SSC Class 10 Board Exam 2021 students whose board examinations were cancelled this year due to the COVID-19 outbreak.

On April 20, 2021, Maharashtra education minister Varsha Gaikwad announced the cancellation of the SSC Class 10 Board Exam 2021. She tweeted, "Given the worsening situation of the #Covid-19 pandemic, the Maharashtra government has now decided to CANCEL the state board exams for class 10th. The health & safety of our students and teachers is our topmost priority. #exams #ssc #hsc." However, till now there has been no clarification on the evaluation scheme for the SSC Class 10 Board Exam 2021 candidates. The Maharashtra HSC exams for class 12 board exam candidates which was scheduled to begin from April 23, 2021 and end on May 21, 2021 has also been postponed.

On Monday, a division bench of Justices S J Kathawalla and S P Tavade was hearing a public interest litigation (PIL) filed by Dhananjay Kulkarni, a professor who challenged  the Maharashtra government's April decision cancelling SSC Class 10 Board Exam 2021. Incidentally, Kulkarni's petition also challenged similar decisions taken by the ICSE and CBSE boards.

Keeping in view the COVID-19 situation of the country, last month, the Central Board of Secondary Education (CBSE) had cancelled the CBSE Class 10 Board Exam 2021 and postponed the CBSE Class 12 Board Exam 2021. After CBSE's decision, the CISCE and several other state boards followed suit. Recently, the CBSE has also announced the evaluation scheme for the CBSE Class 10 Board Exam 2021.

Advocate Kiran Gandhi, appearing for the SSC board, told the court that the petition was filed prematurely. Gandhi informed the court that the SSC board had not devised any formula as yet on how marks would be given to the SSC Class 10 Board Exam 2021 students and the board's examination committee will come up with a formula which would be sent to the state government for final approval. On the other hand, advocate Sandesh Patil, appearing for the Union government, told the court that it has some control over the CBSE board but the ICSE and SSC boards are autonomous and, hence, devoid of any control from the centre.
