Akasa Air can take legal action against pilots who quit without serving notice period: Bombay High Court
The Bombay High Court told AkasaAir on Wednesday that it could consider legal action against the five pilots who left the company without serving their notice periods. The high court said that such a matter comes under its jurisdiction since AkasaAir accepted their resignations in Mumbai.
AkasaAir Pilot Dispute: Akasa Air got a big relief from the Bombay High Court on Wednesday regarding five pilots who left the airline without serving their notice periods. The Bombay HC rules that it has jurisdiction to entertain the suit filed by AkasaAir seeking damages from pilots.
Justice SM Modak observed that part of the cause of action had arisen within the jurisdiction of the Bombay High Court as AkasaAir accepted the resignations (with conditions) in Mumbai.
The court allowed the leave petition filed by AkasaAir and posted the matter for considering the grant of interim reliefs on October 4, 2023.
AkasaAir asked for damages of Rs 21 crore
AkasaAir has sought Rs. 21 crore from each of the five pilots for not serving the notice period before exiting the company and an additional Rs. 18 lakh for alleged breach of employment contract.
