HC restrains LG franchisee from running disparaging campaign against KENT RO
The Delhi High Court has restrained an LG franchisee from running a "disparaging campaign" against Kent RO to promote LG's 'Puricare' range of water purifiers, saying an interim order was "warranted" in the case.
Justice J R Midha also directed YouTube to disable or remove a video uploaded by the franchisee to disparage the water purifiers of Kent.
"The defendant 1 to 3 (the franchise owners), its directors, partners, officers, employees, agents, sales staff advertisers, distributors, franchises, representatives and assigns are restrained from advertising, promoting, printing, publishing any promotional material or running any campaign that directly or indirectly disparages the water purifier (of Kent) till the next date of hearing," the court said in its order of August 31.
The ex-parte interim order came on Kent's plea alleging that the franchisee at its showroom was showing a video to "misguide" customers that disparaged Kent's purifiers by tampering with them and showing them as ineffective.
The court also appointed a local commissioner to visit the showroom and take into custody all the disparaging material, including the tampered Kent products.
It directed the local commissioner to submit her report in a sealed cover before the next date of hearing on September 27.
