Government to Table Bills on Automatic Disqualification of Ministers if Arrested in Serious Cases

Union Home Minister Amit Shah is set to introduce three new criminal law bills in Parliament on Wednesday, August 20.

One of the key provisions specifies that if a prime minister, chief minister, or any minister is arrested in a serious criminal case and does not obtain bail within 30 days, they will automatically cease to hold their position.

3 bills will be introduced, referred to standing committee

  • 130-year-old laws to be repealed: Indian Penal Code (IPC), Code of Criminal Procedure (CrPC), and Indian Evidence Act, 1872, will be repealed
  • New laws to be implemented: Bharatiya Nyaya Sanhita, Bharatiya Nagarik Suraksha Sanhita, and Bharatiya Sakshya Bill, 2023 will be introduced
  • Focus on justice: These bills will replace the colonial-era laws and aim to provide faster and fairer justice

The government argues that these new laws are designed to focus on justice rather than punishment, while also ensuring faster trial procedures.

All three bills are expected to be referred to the parliamentary standing committee for further review and recommendations.

Moreover, the government plans to introduce a regulatory framework for online gaming platforms, particularly targeting gambling-related activities.
