<p>In its latest action, the consumer watchdog imposed a penalty of Rs 10 lakh on Motion Education Pvt Ltd and Rs 5 lakh on Career Line Coaching (CLC) for allegedly publishing misleading advertisements and violating consumer rights under the Consumer Protection Act, 2019.</p>
<p>The orders were passed by the CCPA, headed by Chief Commissioner Nidhi Khare and Commissioner Anupam Mishra, after finding that the coaching institutes made exaggerated claims regarding the success of students in competitive examinations such as IIT-JEE and NEET.</p>
<h2><strong>Misleading use of student data and advertisements</strong></h2>
<p>According to the authority, the institutes prominently used the names, photographs and achievements of successful candidates in advertisements while concealing crucial information about the specific courses opted for by those students. Investigations conducted by the Director General (Investigation) revealed that several students featured in the advertisements had only enrolled in test series programmes, a fact that was not disclosed publicly.</p>
<p>The CCPA also pointed out some contradictions in what Career Line Coaching was saying in its advertisement about “1650+ CLCians in MBBS, IIT &amp; Others”. At first, the institute claimed that this number was basically cumulative selections, going back to 1996. But later, during the hearing, it said that the figure was only for 2024. The authority concluded that these contradictory statements made the statement confusing and basically not supported by evidence.</p>

<p>Further, the regulator observed that both institutes failed to provide documentary evidence showing that written consent had been obtained from successful candidates after the declaration of results, as required under the Guidelines for Prevention of Misleading Advertisement in Coaching Sector, 2024.</p>
<p>The CCPA directed both institutes to immediately discontinue the misleading advertisements, refrain from publishing similar advertisements in future, and ensure truthful and complete disclosures in all future promotional material. However, both institutes have challenged the orders before the National Consumer Disputes Redressal Commission.</p>

<p>Highlighting the importance of transparency in the education sector, the authority said misleading advertisements undermine consumers’ right to accurate information, especially when students and parents invest substantial time and money in coaching services.</p>
<p>The CCPA stated that failure to disclose whether successful candidates attended full-time classroom programmes, online batches, crash courses, foundation programmes or merely test series amounts to misleading advertisement under the Consumer Protection Act.</p>
